1. Overview

These Terms of Service (“Terms”) govern your use of the VoxelMind website, Minecraft mod integration, and related services (“Service”) operated by Nyvoro UG (haftungsbeschränkt), Johann-Georg-Fischer-Straße 18, 73079 Süßen, Germany (“we”, “us”, “our”).

By using our Service, you agree to these Terms. If you do not agree, please do not use the Service.

2. Service Description

VoxelMind provides AI-powered agents for Minecraft. The Service includes a hosted simulation platform and a Minecraft mod that connects AI agents to game servers. VoxelMind does not modify your Minecraft client.

3. Accounts & Eligibility

  • You must be at least 16 years old to use the Service.
  • You are responsible for maintaining the security of your account.
  • You must provide accurate information when creating an account.

4. Sparks & Subscriptions

VoxelMind uses a credit system called “Sparks” to meter AI agent usage. Sparks are consumed during active gameplay sessions.

  • Free tier Sparks refresh daily and do not carry over.
  • Paid subscription Sparks are allocated monthly and do not carry over to the next billing period.
  • Sparks have no monetary value and cannot be transferred, sold, or refunded.
  • We reserve the right to adjust Spark consumption rates with reasonable notice.

5. Acceptable Use

When using VoxelMind, you agree not to:

  • Use the Service to grief, harass, or disrupt other players on shared servers.
  • Exploit the AI agent to gain unfair advantages in competitive gameplay.
  • Attempt to reverse-engineer, decompile, or extract the AI models or proprietary systems.
  • Use the Service to violate the Minecraft EULA or any server’s rules.
  • Automate mass actions intended to damage server infrastructure.
  • Share your account or Sparks with others.

6. Cancellation & Refunds

  • You may cancel your subscription at any time. Access continues until the end of the current billing period.
  • Refunds for unused portions of a billing period are generally not provided, unless required by applicable law.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

7. Right of Withdrawal

As a consumer in the European Union, you have the right to withdraw from a subscription contract within 14 days of purchase without giving any reason (§ 355 BGB).

To exercise your right of withdrawal, send a clear statement (e.g. by email to info@voxel-mind.com) with your name, email address, and the date of purchase.

Early expiry of the right of withdrawal:

If you expressly consent to the Service beginning before the withdrawal period expires and acknowledge that you lose your right of withdrawal upon full performance, the right of withdrawal expires once the digital service has been fully provided. For ongoing subscriptions, you may still withdraw within 14 days; any Sparks or service already consumed will be charged proportionally.

8. AI-Generated Content

VoxelMind agents are powered by artificial intelligence (AI), specifically Google’s Gemini API and Anthropic’s Claude API. All in-game chat, decisions, and actions by agents are generated by AI models — they are not human and do not represent the views or advice of Nyvoro UG.

  • AI-generated responses may be inaccurate, unexpected, or inappropriate. Do not rely on them as factual advice.
  • Nyvoro UG does not guarantee specific agent behavior.
  • You acknowledge that you are interacting with an AI system, not a real person.

9. Updates & Warranty

In accordance with §§ 327–327u BGB (German Civil Code), we provide updates necessary for the contractual conformity of the digital service during the term of your subscription (in particular security and compatibility updates). This obligation does not extend to new features or enhancements.

Statutory warranty rights for digital products apply in addition.

10. Intellectual Property

The VoxelMind name, logo, and software are the property of Nyvoro UG. You may not use our branding without written permission.

11. Limitation of Liability

Nyvoro UG is liable without limitation for damages arising from injury to life, body, or health, as well as for damages based on intentional or grossly negligent breaches of duty.

In the case of slightly negligent breach of material contractual obligations (cardinal obligations), liability is limited to the foreseeable, typically occurring damage.

Any further liability for slightly negligent damage to property or financial loss is excluded.

The Service is provided “as is.” We do not guarantee uninterrupted availability or that the AI agent will behave as expected in all situations.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on our website. Continued use of the Service after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. Mandatory consumer protection provisions of the country in which the consumer has their habitual residence remain unaffected.

14. Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

In case of discrepancies between the German and English versions of these Terms, the German version shall prevail.
